Terms of Service / 服务条款

These are the Terms of Service for the PropertyHunt beta. We may update them as the Service evolves; the current version and its effective date are always shown on this page. These Terms should be read together with our Privacy Policy. Where there is any inconsistency between the English and Chinese text, the English text prevails (the Chinese is provided for convenience). 本文为 PropertyHunt beta 服务条款，可能随服务演进更新；最新版本与生效日期恒于本页显示。本条款应与隐私政策一并阅读。中英文若有不一致，以英文为准（中文仅为便于理解）。

1. Acceptance of Terms / 接受条款

By accessing or using PropertyHunt (the "Service"), you ("you", "the agent", or "the user") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

访问或使用 PropertyHunt（「本服务」）即表示你同意受本条款约束。若不同意，请勿使用。

2. Definitions / 定义

  • "Service" — the PropertyHunt software platform and all related features. / 「本服务」指 PropertyHunt 软件平台及相关功能。
  • "Agent" — a property agent who registers for and uses the Service. / 「中介」指注册并使用本服务的房地产中介。
  • "Owner" — a property owner whose listing details are collected from public platforms. / 「业主」指其房源信息从公开平台采集的产权所有人。
  • "Tenant" — a prospective tenant whose details are entered into the Service. / 「租客」指其资料录入本服务的潜在承租人。
  • "Listing" — a property listing record within the Service. / 「房源」指本服务内的房源记录。
  • "Personal Data" — has the meaning given in the PDPA 2010. / 「个人资料」依 PDPA 2010 定义。

3. The Service / 服务描述

PropertyHunt is a software tool ("virtual admin") for property agents in Kuala Lumpur and Selangor. The Service helps agents:

PropertyHunt 是面向吉隆坡与雪兰莪房地产中介的软件工具（「虚拟助理」）。本服务帮助中介：

  • Collect owner-direct property listings from public platforms (such as Mudah) into a single workspace. / 从公开平台（如 Mudah）收集业主直盘房源到统一工作台。
  • Maintain the agent's own listings ("Masterlist") and privately-recorded owner listings ("Owner Direct"). / 维护中介自有房源（Masterlist）与私有录入的业主名单（Owner Direct）。
  • Organise and follow up on listings and prospective tenants (status tracking, notes). / 整理并跟进房源与租客（状态、笔记）。
  • Match the agent's available listings against a tenant's stated requirements. / 将中介可用房源与租客所述需求配对。
  • Manage prospective-tenant ("Client") records. / 管理潜在租客（Client）记录。
  • Send the agent summary emails and optional Telegram notifications. / 向中介发送摘要邮件与可选 Telegram 通知。

What the Service does not do / 本服务不做的事:

  • The Service does not act as a property agent, broker, or your legal representative. / 不作为房地产中介、经纪或法律代理。
  • The Service does not automatically contact owners or tenants on your behalf; contacting an owner/tenant is the agent's own action using the agent's own tools. / 不代你自动联系业主或租客；联系由中介用自己的工具自行执行。
  • The Service does not guarantee the accuracy, availability, legality, or authenticity of any listing or owner contact detail collected from third-party platforms. / 不保证第三方平台房源或业主联系方式的准确性、有效性、合法性或真实性。
  • The Service does not guarantee any transaction, lead conversion, or commercial outcome. / 不保证任何成交、线索转化或商业结果。

4. Eligibility and Accounts / 资格与账号

You must be at least 18 years old and legally able to enter into a binding contract to use the Service.

你须年满 18 岁且具备订立有约束力合同的能力。

PropertyHunt is a workspace tool and does not require you to hold a real-estate licence/registration (REN/REA/BVEAP) to register. You are responsible for ensuring that your own use of the Service complies with any licensing, registration, or professional-conduct rules that apply to you under Malaysian law.

PropertyHunt 为工作台工具，不要求你持有房地产执业资格（REN/REA/BVEAP）方可注册。你须自行确保你对本服务的使用符合适用于你的任何执业/注册/专业操守规定。

You are responsible for: maintaining the confidentiality of your login credentials; all activity under your account; and notifying us promptly of any unauthorised use.

你负责：保管登录凭证、你账号下的一切活动、及时告知未经授权的使用。

5. Acceptable Use / 可接受使用

You agree not to:

  • Use any personal data accessed through the Service (including owner and tenant contact details) for any purpose other than your legitimate property-agency activities. / 将通过本服务获取的个人资料用于正当房地产中介活动以外的目的。
  • Harass, spam, or repeatedly contact owners or tenants against their wishes. If an owner or tenant asks not to be contacted, you must stop contacting them. / 骚扰、滥发或违背业主/租客意愿反复联系。若业主/租客要求勿联系，你须停止联系。
  • Resell, redistribute, or scrape data out of the Service. / 转售、再分发或从本服务抓取数据。
  • Use the Service in violation of the PDPA 2010 or any other applicable law. / 以违反 PDPA 2010 或其它适用法律的方式使用。
  • Attempt to gain unauthorised access to the Service or its underlying systems. / 试图未经授权访问本服务或其底层系统。

6. Your Responsibilities Regarding Personal Data / 你对个人资料的责任

PropertyHunt provides the Service as a tool. When you use the Service to handle the personal data of owners and tenants, you are responsible for your own processing of that data and agree to comply with your obligations under the PDPA 2010 (including, where you enter a tenant's data, having an appropriate basis such as the tenant's consent).

PropertyHunt 以工具身份提供本服务。当你使用本服务处理业主与租客的个人资料时，你对自身的处理负责，并同意遵守你在 PDPA 2010 下的义务（包括录入租客资料时具备适当基础，如租客同意）。

7. Data from Third-Party Platforms / 第三方平台数据

Listing and owner data surfaced through the Service may be collected from third-party platforms such as Mudah. We do not control those platforms, do not warrant the accuracy of their data, and are not responsible for their content or terms.

通过本服务呈现的房源与业主数据可能采集自 Mudah 等第三方平台。我们不控制这些平台、不保证其数据准确性、不对其内容或条款负责。

8. Intellectual Property / 知识产权

All software, design, text, and other materials forming part of the Service (excluding user-submitted content and third-party listing data) are owned by us or our licensors. You retain ownership of the content you enter (e.g. tenant records, notes); you grant us a limited licence to host and process that content solely to operate the Service for you.

构成本服务的软件、设计、文本等（用户提交内容及第三方房源数据除外）由我们或许可方拥有。你录入的内容归你所有（如租客记录、笔记）；你授予我们有限许可，仅为向你提供本服务而托管与处理该内容。

9. Fees and Subscription / 费用与订阅

During the beta, the Service is provided free of charge. If we introduce paid subscriptions, the price, billing cycle, and any refund terms will be shown in the Service before you subscribe, and your decision to subscribe and continue using the paid Service constitutes acceptance of those terms.

beta 期间本服务免费提供。若我们引入付费订阅，价格、计费周期与退款条款将于订阅前在服务内显示；你选择订阅并继续使用付费服务即视为接受该等条款。

10. Disclaimers / 免责声明

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by Malaysian law. We do not warrant that the Service will be uninterrupted, error-free, or that any listing data is accurate, current, or lawful.

本服务按**「现状」及「可得」**基础提供，在马来西亚法律允许最大范围内不附带任何明示或默示保证。我们不保证服务不中断、无错误，亦不保证任何房源数据的准确性、时效性或合法性。

11. Limitation of Liability / 责任限制

To the maximum extent permitted by Malaysian law, our total aggregate liability arising out of or relating to the Service shall not exceed the total fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential losses, or loss of profit, data, or goodwill.

在马来西亚法律允许最大范围内，我们就本服务的累计责任上限为索赔事件发生前 12 个月你向我们支付的费用总额；我们不对间接、附带、特殊或后果性损失，或利润/数据/商誉损失负责。

12. Indemnification / 赔偿

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service or your breach of these Terms or of applicable law (including the PDPA 2010).

你同意就因你滥用本服务，或违反本条款或适用法律（含 PDPA 2010）引起的索赔，向我们赔偿并使我们免受损害。

13. Suspension and Termination / 暂停与终止

We may suspend or terminate your access to the Service if you breach these Terms or use the Service unlawfully. You may stop using the Service at any time. On termination, your data is deleted within 90 days, except records we are required to keep by law (e.g. billing/tax records) — consistent with the retention periods in the Privacy Policy §8.

若你违反本条款或非法使用，我们可暂停或终止你的访问。你可随时停止使用。终止后你的数据在 90 天内删除，法律要求保留者除外（如账单/税务记录）——与隐私政策第 8 节保留期限一致。

14. Governing Law and Dispute Resolution / 适用法律与争议解决

These Terms are governed by the laws of Malaysia. The courts of Malaysia shall have jurisdiction over any dispute arising out of or relating to these Terms (no arbitration).

本条款受马来西亚法律管辖；马来西亚法院对相关争议有管辖权（不采仲裁）。

15. Changes to These Terms / 条款变更

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Material changes are notified by email to registered agents and posted within the Service; minor changes are posted within the Service only — consistent with Privacy Policy §13.

我们可能不时更新本条款。变更生效后继续使用即视为接受修订后条款。重大变更经邮件通知已注册中介 + 站内公布、小改仅站内公布——与隐私政策第 13 节一致。
